Religious offering is a ritual worship dealt with the relationship to God and to human being and also it is closely related with economic social. The rich people are recommended to offer the rites in order to share the meat to the poor who rarely consume meat, in order that they could bring them closer to God and thank to Him. The rites of religious offering is a ritual of the Prophet Ibrahim As. Together with the Prophet Ismail As. Nowadays, there are many people carrying out rites of religious offering. However, most people sell the animal-skinned and it was not appropriate. In this matter, the Hanafi and Syafi’I schools have different argument on trading the religious offering animal-skinned.
The problems of the study are:
1.How is the Islamic law on trading religious offering animal-skinned in the perspective of Hanafi and Syafi’I schools?
2.What are the factors of allowing and forbidding trading religious offering animal-skinned in the perspective of Hanafi and Syafi’I schools?
3.How is the relevance of the perspective of Hanafi and Syafi’I schools on trading religious offering animal-skinned with the situation of today’s society?
The aim of the study is to investigate the position of trading religious offering animal-skinned in the perspective of Hanafi and Syafi’I schools, to describe the different argument of Hanafi and Syafi’I schools on trading religious offering animal-skinned and to know the relevance between the two schools on trading religious offering animal-skinned with the situation of today’s society. The data were obtained from library research and presented through deductive and descriptive method. Then, the data were analysed using content analysis and comparative analysis.
Based on the result of the study on trading religious offering animal-skinned in the perspective of Hanafi and Syafi’I schools, in general, Hanafi School allowed trading religious offering animal-skinned. Its argument was that to obtain the advantages of animal-skinned based on the prophet saying as narrated by Ibn Majah. On the contrary, Syafi’I School forbidened trading religious offering animal-skinned. Its argument was based on the prophet saying as narrated by Imam Ahmad and Baihaqi. The different view of the two schools was derived from the taken basic argument of law, the prophet saying. They also differed in quoting the prophet saying as the basic argument after the Qur’an. After examining both arguments of the schools, the strong arguments were those who forbid on trading religious offering animal-skinned. Since, in today’s society, the distribution of meat was not completely covered all the poor yet. There were many people who did not receive the meat. Therefore, the animal-skinned should be given to the poor who did not get the meat. Based on that argument, it was more appropriate if the animal-skinned was given to the poor who did not get the meat. It would more be beneficial than being sold.
